HB296 would require a mandatory 24-hour hold for anyone who resists arrest, while keeping resisting arrest as a Class B misdemeanor.
The bill amends Section 13A-10-41 to create a mandatory temporary holding period for people who resist arrest. If someone resists arrest, they must be kept in custody and cannot be released on bail or otherwise until 24 hours have passed from the time of the arrest. After that 24-hour period, release may be allowed under existing laws. Resisting arrest remains classified as a Class B misdemeanor.
