HB58 would create a criminal penalty for failing to inform a law enforcement officer when asked about possessing a concealed pistol or firearm, making it a Class A misdemeanor, effective October 1, 2025.
Currently, anyone asked by an officer about possessing a concealed pistol or firearm has a duty to inform, but there is no penalty. HB58 amends Section 13A-11-95 to require a person who knowingly possesses a concealed pistol or firearm on their person or in a vehicle and is asked by a law enforcement officer in the line of duty to immediately inform the officer that they possess the pistol or firearm. A violation would be a Class A misdemeanor. The change takes effect on October 1, 2025.
