HB95 requires automatic transfer of an unexpired HVAC warranty to the new owner when residential property with an HVAC system is sold, with no transfer fee and without extending the warranty term.
If a home with an HVAC system is sold on or after October 1, 2025, any unexpired warranty on the system or its components automatically transfers to the new owner and remains in effect as if they were the original purchaser. The warrantor must honor the warranty under its terms and may not charge a fee for the transfer. The transfer does not extend the warranty's remaining term. Warranties entered into or renewed after October 1, 2025 are covered by this act, while warranties entered before that date follow the law in effect at the time of the agreement; the act itself takes effect on October 1, 2025.
