- Public contracts, waiver of payment within 30 days prohibited, interest added on any dollar amount approved and unpaid, certification and proof of certification of availability of funds, attorney fees and court costs, Sec. 41-16-3 am'd.
- Description
This bill would prohibit the waiver of payment within 30 days after the completion of a public contract and would provide for interest of one percent to be added on any dollar amount approved and unpaid for each month or fraction thereof until final payment is made.
This bill would require certification and proof of certification of the availability of funds to remit payment once the party to the contract has fully executed the responsibility under the contract.
This bill would provide that in any civil action, the owner, the contractor, or sub-contractor in whose favor a judgment is rendered would be entitled to recover attorneys' fees and court costs.
