SUSTAINING THE DISAPPROVAL BY THE JOINT COMMITTEE ON
ADMINISTRATIVE REGULATION REVIEW OF THE DEPARTMENT OF PUBLIC
HEALTH'S PROPOSED AMENDMENT OF CHAPTER 420-7-2, APPENDIX "A"
ENTITLED "CONTROLLED SUBSTANCES LIST."
WHEREAS, the Department of Public Health filed a
"Notice of Intended Action" of a proposed amendment to Chapter
420-7-2, Appendix "A", entitled "Controlled Substances List,"
which notice was published in the Alabama Administrative
Monthly, dated November 30, 2016; and
WHEREAS, the Department of Public Health certified
to the Legislative Reference Service (now known as the
Legislative Services Agency, Legal Division) the adoption of
the proposed amended chapter, which was the subject of review
at a meeting of the Joint Committee on Administrative
Regulation Review on April 13, 2017; and
WHEREAS, after hearing from interested persons, the
Joint Committee, in accordance with Section 41-22-23, Code of
Alabama 1975, disapproved the proposed amendment of Chapter
420-7-2, Appendix "A"; now therefore,
BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH
HOUSES THEREOF CONCURRING, That the decision of the Joint
Committee on Administrative Regulation Review to disapprove
the proposed amendment of Chapter 420-7-2, Appendix "A",
entitled "Controlled Substances List," is sustained.
