ENCOURAGING STATE-SUPPORTED COLLEGES AND
UNIVERSITIES TO WAIVE OUT-OF-STATE TUITION FOR THE DEPENDENTS
OF CERTAIN DISABLED ALABAMA SERVICE MEN AND WOMEN.
WHEREAS, under the Alabama G.I. and Dependents'
Educational Benefit Act, the dependents of certain Alabama
disabled veterans were entitled to receive free tuition, fees,
and books at state institutions of higher education and state
trade schools; and
WHEREAS, Act 2017-349, 2017 Regular Session, which
amended numerous sections of the Alabama G.I. and Dependents'
Educational Benefit Act, included a requirement that
dependents of certain Alabama disabled veterans, who are
living outside of Alabama, pay out-of-state tuition rates; and
WHEREAS, the total number of affected dependents is
WHEREAS, Section 31-6-15 of the Code of Alabama
1975, provides that any "amount of in-state tuition, books, or
fees not paid by the combination of federal, state, and third
party funds may be billed to students receiving such benefits
or waived by the institution or school; now therefore,
BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH
HOUSES THEREOF CONCURRING, That state-supported institutions
of higher education and community and technical colleges in
the state are encouraged to waive out-of-state tuition for
those dependents of Alabama disabled veterans who are affected
by Act 2017-349 and who enroll in the institution or college.
BE IT FURTHER RESOLVED, That a copy of this
resolution be provided to each institution and college so that
they may know of our intent.
BE IT FURTHER RESOLVED, That, in turn, each
institution and college notify the Chair of the Senate Finance
and Taxation Education Committee, the Chair of the House Ways
and Means Education Committee, and the Commissioner of the
Alabama Department of Veterans Affairs of its intent to waive
out-of-state tuition pursuant to this resolution.
