Franklin Co., sales and use tax, allocation of one-quarter of one cent tax for road and bridges in lieu of ATRIP, tax extended, referendum deleted, Amendment 881 (Section 9.50, Local Amendments, Franklin Co, Recompiled Constitution of Alabama of 1901, as amended) am'd, const. amend.
Description

Under existing law, applicable to Franklin County, pursuant to Amendment 881 of the Constitution of Alabama of 1901, now appearing as Section 9.50 of the Franklin County Local Amendments to the Recompiled Constitution of Alabama of 1901, as amended, the Franklin County Commission may allocate one-fourth of an existing one cent sales tax levied under general law for public schools for matching state grants under the Alabama Transportation Rehabilitation and Improvement Program. The allocation is for two-year periods subject to recurring referendums

This bill would propose a local constitutional amendment relating to Franklin County, to amend Amendment 881 of the Constitution of Alabama of 1901, to specify that the county governing body may allocate one-fourth of the proceeds from the existing one cent sales tax for public schools in Franklin County for the purpose of costs associated with construction, maintenance, and repair of roads and bridges in Franklin County, not to include use for salaries, personnel costs, or the purchase or lease of new equipment, would provide for the continuing distribution of the revenue for 30 years, and would delete the requirements for recurring referendums

Section 1

The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled: PROPOSED AMENDMENT

Amendment 881

Notwithstanding the provisions of Section 40-12-4, Code of Alabama 1975, commencing October 1, 2014, the governing body of Franklin County, by ordinance, may allocate one-fourth of the proceeds of the one cent tax levied in Franklin County pursuant to Section 40-12-4, Code of Alabama 1975, for the purpose of matching funds for any grant in Franklin County from the Alabama Transportation Rehabilitation and Improvement Program costs associated with construction, maintenance, and repair of roads and bridges in Franklin County, not to include use for salaries, personnel costs, or the purchase or lease of new equipment. The authority granted by this amendment is effective for two 30 years from the effective date of this amendatory amendment. The authority may be extended from time to time for subsequent two-year periods if approved by a majority vote of the voters of Franklin County voting on the issue at an election called for that purpose."

Section 2

An election upon the proposed amendment shall be held in accordance with Section 284 and Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3

The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

50 of the Franklin County Local Amendments to the Recompiled Constitution of Alabama of 1901, as amended, to specify that the county governing body may allocate one-fourth of an existing one cent sales tax for public schools in Franklin County for costs associated with construction, maintenance, and repair of roads and bridges in Franklin County, not to include use for salaries, personnel costs, or the purchase or lease of new equipment, to provide for the continuing distribution of the revenue for 30 years, and to delete certain requirements for recurring referendums.
