Under existing law, the State Pilotage Commission has three members appointed by the Governor
This bill would increase the membership of the commission from three to four members and would provide for the qualifications of the additional member
To amend Section 33-4-1, Code of Alabama 1975, relating to the State Pilotage Commission, to increase the membership of the commission from three to four members; and to provide for qualifications.
Relating to the Alabama Sunset Law; to continue the existence and functioning of the State Pilotage Commission until October 1, 2020, with certain modifications; to amend Section 33-4-1, Code of Alabama 1975, to authorize the Governor to appoint an advisory member to the commission
Section 1
Pursuant to the Alabama Sunset Law, the Sunset Committee recommends the continuance of the State Pilotage Commission until October 1, 2020, with the additional recommendation for statutory change as set out in Section 3.
Section 2
The existence and functioning of the State Pilotage Commission, created and functioning pursuant to Sections 33-4-1 to 33-4-57, inclusive, Code of Alabama 1975, is continued until October 1, 2020, and those code sections are expressly preserved.
Section 3
Section 33-4-1 of the Code of Alabama 1975, is amended to read as follows: "§33-4-1. "(a) There shall be a board of pilotage commissioners, to be known as the State Pilotage Commission, which shall consist of three voting members, one to . One SB222 voting member shall be an official of a steamship company which maintains an office in Mobile, one to voting member shall be an active bar pilot, licensed and branched by such the State Pilotage Commission, and one to voting member shall be a business man person or a person engaged in a professional occupation licensed by the State of Alabama. "(b) An additional member, who shall serve in a nonvoting advisory capacity, may be appointed to the commission by the Governor from a list of nominations by the Chair of the Alabama State Port Authority. Any provision of Section 33-4-3 to the contrary notwithstanding, the advisory commissioner shall serve without reimbursement for expenses incurred on behalf of the commission and shall submit no commissioner's fees. "(c) The membership of the commission shall be inclusive and reflect the racial, gender, geographic, urban/rural, and economic diversity of the state. "(d) The Such State Pilotage Commission shall have such the powers and duties as are prescribed in this chapter and as may hereafter be prescribed by law. "(e) A quorum for the transaction of commission business shall be two voting members of the commission."
Section 4
The Legislature concurs in the recommendations of the Sunset Committee as provided in Sections 1, 2, and 3. SB222
Section 5
This act shall become effective immediately upon its passage and approval by the Governor, or its otherwise becoming law.
