Description

Existing law allows an active and contributing member of the Employees' Retirement System to be eligible for a certain number of years of creditable service under certain conditions if he or she was a regular employee prior to October 1, 2000

This bill would remove the qualification that the employee had to be employed prior to October 1, 2000, to be eligible for the service credit

To amend Section 36-27-70 of the Code of Alabama 1975, relating to reopening of service credits for certain employees of local agencies or organizations; to remove the qualification that the employee had to be employed prior to October 1, 2000, to be eligible for the service credit.

To amend Section 36-27-70 of the Code of Alabama 1975, relating to reopening of service credits for certain employees of local agencies or organizations; to remove the qualification that the employee had to be employed prior to October 1, 2000, to be eligible for the service credit.

Section 1

Section 36-27-70 of the Code of Alabama 1975, is amended to read as follows:

§36-27-70.

Any active and contributing member of the Employees' Retirement System who prior to October 1, 2000, was a regular employee of an agency eligible for participation in the Employees' Retirement System under Section 36-27-6 and is now covered by the Employees' Retirement System shall be eligible to receive up to eight years of creditable service for the employment, provided that the member of the Employees' Retirement System claiming the credit shall have attained not less than five years of contributing membership service credit exclusive of military service credit under the Employees' Retirement System, has not received credit for the same prior service under any retirement system other than the federal Social Security program, and provided further, that the member performs and complies with the conditions prescribed in Section 36-27-71."

Section 2

This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
