HB91 authorizes Columbiana to create up to two entertainment districts, regulate their operation, and impose penalties for violations.
The City Council can designate up to two entertainment districts within the city, each no larger than 0.5 mile by 0.5 mile. Licensees with on-premises alcohol licenses in those districts can obtain an entertainment district permit, and the city’s ordinance will set hours and other operating rules and may revoke the designation. Patrons may exit with open alcohol within the district, but may not take it into other licensee premises, and non-licensees may not possess or bring in outside alcohol during district hours; the city will enforce the ordinance and penalties for violations will apply. The act also repeals conflicting laws and becomes effective immediately after passage.
