SB244 requires an uninsured design professional to disclose that lack of liability insurance in writing to the client, with the client signing and notarizing before any work begins.
It adds a new requirement (Section 41-9A-3.1) to Alabama law. Before an uninsured design professional can start work, they must provide a written disclosure of their lack of professional liability insurance, and the client must sign and have that disclosure notarized. The bill defines which professionals count as design professionals (architecture, landscape architecture, surveying, engineering, interior design, geology) and sets an effective date of September 1, 2023.
