Schools in unincorporated areas of county, reduced speed school zones on roads and highways established, signs required, Transportation Department to provide signs on state highways, fines doubled, County and Municipal Reduced Speed School Zone Act
Description

Under existing law, a municipality may establish a school zone. However, county commissions are not granted specific authority to establish school zones in the unincorporated area of the county

This bill would authorize a county commission to establish reduced speed school zones along roads or highways except interstate highways outside of the corporate limits of a municipality under certain conditions. This bill would also provide for the maintenance of the signs

This bill would provide that the fine for a speeding violation in a school zone in a municipality or in the unincorporated area of a county would be doubled as provided for in this bill

This bill would provide for the distribution of the funds collected from any fines for a violation

Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, prohibits a general law whose purpose or effect would be to require a new or increased expenditure of local funds from becoming effective with regard to a local governmental entity without enactment by a 2/3 vote unless: it comes within one of a number of specified exceptions; it is approved by the affected entity; or the Legislature appropriates funds, or provides a local source of revenue, to the entity for the purpose

The purpose or effect of this bill would be to require a new or increased expenditure of local funds within the meaning of the amendment. However, the bill does not require approval of a local governmental entity or enactment by a 2/3 vote to become effective because it comes within one of the specified exceptions contained in the amendment

Relating to county commissions and schools outside of the corporate limits of municipalities; to authorize a county commission to establish a reduced speed school zone on any road or highway in the immediate area surrounding a school in order to ensure the safety of school children and other persons entering and leaving school property; to provide for maintenance of the signs; to provide that the fine for a traffic violation in a school zone would be doubled; to provide for the distribution of the funds collected from any fines for a violation; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as amended.
